The Justice and Labor departments announced a coordinated settlement with Santa Clara-based Cloudera on October 16 over allegations of discrimination against qualified U.S. workers in recruitment under the Permanent Labor Certification program, known as PERM.

The resolution bars the company from PERM participation for two years. It also provides a $1.4 million back-pay fund for qualified workers affected by the recruitment at issue and $600,000 in civil penalties, according to the Justice Department.

The agreement resolves a lawsuit filed in April concerning seven positions. The program ordinarily requires employers seeking labor certification to demonstrate that qualified U.S. workers had a genuine opportunity to apply. The case concerns those recruitment obligations, not a general ban on all company hiring.

Cloudera will also face monitoring, reporting requirements and revised compliance procedures. Those are future obligations under the settlement; the announcement does not establish that every compliance step or payment has already been completed.
